What Texas Leaves to Whoever Holds the W-2
Texas regulates employment more lightly than most states. That sounds like it should make temporary coverage simpler. Sometimes it does. Some of it just moves the risk somewhere less visible.
Workers’ comp is the clearest case. Texas is the one state that still lets most private employers decline the coverage outright, and about a quarter of private-sector employers here do, according to the Texas Department of Insurance’s 2022 estimates. If your company is one of them, a contractor you pay directly is a question with no comfortable answer. On our W-2, the person is covered by our policy for every day of the assignment.
Final pay runs on a clock as well. The Texas Payday Law gives an employer six calendar days to pay someone it lets go, in full. We’re the employer. That clock is ours, along with the withholding and the unemployment account.
Sometimes the honest finding at intake is that temp is the wrong tool. When the work will outlast any end date you’d write down, contract staffing puts a real term on it. Contract-to-hire suits a seat you’d keep if the person turns out right. Project staffing fits a capacity gap rather than one missing person, backfill coverage holds a chair while the permanent search runs, and direct hire is the answer when the gap was always a permanent job.

Either one is routine, since an extension only moves the end date and a conversion to your payroll carries a fee that drops as the person’s hours on assignment add up.
Want to keep them? Say so at intake. Framing the search as contract-to-hire draws a stronger Austin pool, because plenty of good people will take a defined window specifically to audition a company they’d stay at.
